Home Occupations

The city’s land use ordinance permits home occupations by right, subject to use-specific standards. Home occupations must comply with location and space, dwelling modification, display, storage, employee, sign, vehicle, parking, traffic, customer/client visitation, nuisance, and sales standards (§§18.2.3.150.B18.2.3.150.C.1 & 2). It prohibits specific uses and “uses with similar objectionable impacts because of automobile traffic, noise, glare, odor, dust, smoke, or vibration” (§18.2.3.150.C.3).

Marijuana-Related Uses

The city’s land use ordinance permits multiple medical- and recreational-marijuana-related uses by right, subject to use-specific standards (§18.2.2). It defines “homegrown marijuana cultivation” and five types of “marijuana-related business”: laboratory, processing, production, retail, and wholesale.

Its use-specific standards for homegrown marijuana cultivation address owner occupation, related activities, outdoor cultivation, and indoor cultivation (§18.2.3.190.A).

Its use-specific standards for all marijuana-related businesses address permanent buildings, exterior and site modifications, waste disposal, light and glare, building code compliance, measuring separation requirements, liability waivers, and state licensing (§18.2.3.190.B).

Additional standards for marijuana laboratories, processing, production, and wholesale address separation from residential districts, maximum gross floor area for production, separation between production facilities, and separation between wholesale facilities (§18.2.3.190.B.2).

Additional standards for marijuana retail sales address boulevard access, separation from residential districts, sales in the Downtown Design District, separation between retail facilities, and drive-up uses (§18.2.3.190.B.3).

Solar Energy

The city’s land use ordinance provides solar definitions (§18.6.1.030), lot classification standards, solar setback standards, and a solar access performance standard. It allows for variances with signature of shaded property owners. Owners may obtain solar access permits for protection from shading, to be filed with County Clerk; the code details the hearing procedure (§18.4.8).
