The city's zoning code includes an extensive article on solar energy (§595-37). The article begins with a purpose statement stating the benefits of solar energy and the intent of the ordinance to promote the use of solar energy systems and to protect solar access (§595-37.A). It provides a number of definitions relating to solar energy systems and solar access calculations (§595-37.B). The ordinance allows building-mounted solar energy systems as an accessory use in both residential and nonresidential districts, and provides for variances to achieve solar access (§595-37.C). Design and installation standards address aesthetics and encourage the placement of roof-mounted systems to limit or prevent visibility from public ways on both low-slope and steep-slope roofs (§595-37.D).
The ordinance also addresses solar access, requiring that new accessory structures or vegetation on lots adjoining those with solar energy systems not interfere with designated solar access requirements; existing structures and vegetation is exempt. These provisions do not guarantee a permanent easement, but impacts to existing solar energy systems are considered as part of development review. If a solar energy system is impacted by adjacent accessory structures or vegetation, the burden of proof is on the system owner (§595-37.E).
The code describes application requirements for solar energy system installations (§595-37.F). It also provides for the designation of solar easements in new land or subdivision development or for existing sites, and lists the recommended contents of a solar easement covenant (§595-37.G). Finally, the ordinance requires that "abandoned" systems (those not operated for a continuous 6-month period) be removed within 90 days of notice from the city (§595-37.H).
