Solar Energy

The town's zoning code provides standards for solar energy systems. It requires solar and wind energy systems to meet height regulation requirements (§117-50).

Solar energy systems are conditional uses in all zoning districts (§117-79, Table 1). The code provides standards for solar energy systems (§117-128). A permit is required before installation; the code specifies application requirements. The zoning administrator may approve, deny, or conditionally approve the application. Design criteria address setback and height limits. Adjacent property owners within 300' must be notified by the town. Adjoining property owners are not required to remove any structures or trim any vegetation that may block sunlight to the system.

The land division section of the code provides that subdividers may require easements to assure the unobstructed flow of solar or wind energy across adjacent lots (§115-53.h.8).
