Group HOusing
The city's development code establishes "residential facility for groups" as a residential use for ten or fewer aged, infirm, mentally retarded, or handicapped residents.
It is permitted in compliance with standards in all residential and mixed use districts (§19.5.3.G). Standards include a separation requirements of 660 feet; if this requirement is not met, conditional use approval is required. The code provides conditions for conditional use approval.
The parking requirement is at least 1 space per 5 residents.
Marijuana-Related Uses
The city’s development code permits multiple types of medical-marijuana-related uses either by right or with a discretionary use permit, subject to use-specific standards (§19.5.5.Y). It defines “medical marijuana cultivation facility,” “medical marijuana dispensary,” “medical marijuana infusion or manufacturing facility,” and “medical marijuana independent testing laboratory.”
Its use-specific standards for medical marijuana cultivation and infusion or manufacturing facilities and independent testing laboratories address zoning district use permissions; compliance with local licensing requirements; separation from schools, community facilities, and parks and playgrounds; emissions; permanent building requirements; outdoor storage; retail sales; minimum size; window transparency; signage; conditional use permit terms; off-street parking, and off-street loading (§19.5.5.Y.3, §19.5.5.Y.5 & §19.5.5.Y.6).
Its use-specific standards for medical marijuana dispensaries address zoning district use permissions; compliance with local licensing requirements; separation from other dispensaries, schools, community facilities, and parks and playgrounds; hours of operation; drive-through services; emissions; minimum size; outdoor seating; outdoor display; permanent building requirements; outdoor storage; window transparency; signage; conditional use permit terms; colocation with cultivation in industrial districts; off-street parking, and off-street loading (§19.5.5.Y.4).
Solar Energy
The city's development code permits accessory ground-mounted and rooftop solar energy systems in all zoning districts by right, subject to specific development standards governing placement and appearance. These standards grant a limited exception to height restrictions (§9.5.7.D.10).
These regulations also stipulate that property owners may protect solar access through a solar easement recorded with the County Recorder (§9.5.7.D.10.(b)(4)).
The city's development code requires development projects (other than new or renovated single-family homes) to obtain a minimum number of sustainability points by selecting from a menu of optional features. These features include installation of solar energy systems, solar-oriented site design, and solar-ready design (Table 19.7.11-1).
