The borough's subdivision regulations includes a section on considerations for solar access (Sec. 195-34). The code provides that streets should run in an east-west direction and side lot lines may vary from right angles to provide for maximal use of solar energy. Buildings should also be oriented for maximum solar access and should not cast shadows on other buildings. The code suggests considering solar easements to protect solar access to lots.
The borough's zoning code includes a section of supplementary regulations for alternative energy systems, including solar (Sec. 225-33.3). The code defines several solar-related terms, including "small-scale" and "large scale" systems. It allows accessory wind and solar energy systems in all district subject to standards, which address height, setbacks, lot coverage, stormwater management, glare, and noise. A zoning permit and a building permit are required. Building-integrated systems are permitted regardless of visibility. Abandoned systems (those inactive for 6 months or more) must be repaired or removed. These code provisions sunset five years after adoption, at which point they will be reviewed and revised to account for new technologies.
