This guide includes model zoning provisions and commentary for accessory solar energy systems and solar energy systems as a primary land use.
These model provisions recommend permitting accessory solar energy systems by right in all zoning districts, subject to specific location, height, setback, and glare minimization standards (p. 13).
The accessory use provisions also recommend preempting private codes, covenants, and restrictions that are more restrictive than the municipal standards (p. 16).
These model provisions recommend permitting primary use solar energy systems by right in commercial and industrial districts and as a special exception in agricultural districts, subject to specific lot size, height, setback, location, glare minimization, and decommissioning standards (pp. 36-37).
