solar energy

The city's zoning code includes a section on supplemental regulations for solar energy systems. It addresses the granting of solar access permits by the plan commission, describing the process for permit application and approval (Sec. 78-1421). Permit holders are entitled to an injunction to require the trimming of any vegetation that creates an impermissible interference with the system (Sec. 78-1426). Permits terminate if the system is removed or out of commission for two consecutive years or the system is not installed within two years (Sec. 78-1451). If the city provides for trimming of vegetation that blocks solar access, the solar collector owner is responsible for paying the costs (Sec. 78-1455).

The code defines "collector surface," "collector use period," and "impermissible interference" (Sec. 78-1).

The city's historic preservation ordinance provides review criteria for alterations in historic districts that involve solar apparatus: passive and active systems are allowed only if they do not detract from the building's architectural integrity, do not hide significant architectural elements from street view or result in their removal, and are not large enough that they become a major feature of the design (Sec. 34-162.3).
