Section 27-1126 of the zoning ordinance establishes provisions for the design, permitting, construction and operation of alternative and emerging energy facilities. It defines alternative energy, alternative energy facility, attached alternative energy facility, emerging energy, and emerging energy facility. Solar energy systems are permitted by right if they are located on a lot with a permitted use (Sec. 27-1126.B.1) and must meet the permitted building height requirements of the zoning district on which they are located ( Sec. 27-1126.B.2). Freestanding alternative energy systems shall be located at least 15 feet from a property line and shall not exceed 15 feet in height. All systems must comply with building and lot coverage requirements of the zoning district on which it is located (Sec. 27-1126.B.3). Solar energy systems shall be located, designed and installed as per the manufacturer’s specifications as well as all zoning, building code and utility requirements (Sec. 27-1126.B.4); they must be located behind front facades and are prohibited in front yards (Sec. 27-1126.B.5). The ordinance prohibits nonparticipating landowners from blocking or interfering with existing solar energy systems. If this occurs, the matter shall be resolved as a civil dispute between the landowners and the Township is not responsible (Sec 27-1126.B.6). Glare must be minimized (Sec 27-1126.B.7). The ordinance includes renewable energy resource protection provisions to assure adequate solar access. This includes providing documentation and notifying the Zoning Officer when the system has been installed ( (Sec 27-1126.F).
