Tiny Houses and Micro-Apartments

This multijurisdictional development code defines and regulates tiny houses as a distinct type of dwelling and tiny house subdivisions as a distinct type of subdivision. Its definition for “tiny house” specifies that chassis-mounted units are regulated as recreational vehicles and foundation-attached units are regulated as accessory dwelling units (§109). Its definition for “tiny house subdivision” applies to a land subdivision for the purpose of constructing tiny houses as principal dwelling units (§109).   

Recreational vehicles are only permitted for habitation in recreational vehicle parks or campgrounds, which are considered commercial planned unit developments (§109). Accessory dwelling units are permitted in multiple residential districts, subject to use-specific standards (§302 & §604).  

Tiny house subdivisions are permitted as planned unit developments, subject to standards addressing location, density, ownership structure, structural independence, lot size, setbacks, open space, design review, and utilities (§1101.F).
