Marijuana-Related Uses
The city’s zoning code permits multiple types of medical-marijuana-related uses either by right or with a discretionary use permit, subject to use-specific standards. It defines “medical marijuana dispensary,” “medical marijuana growing/manufacturing facility,” and “medical marijuana home occupation” (§122.203).
Its use-specific standards for medical marijuana dispensaries address compliance with state law, separation from schools and other marijuana-related uses, on-site use or consumption, outdoor activities, inspections, recordkeeping, cessation of operations, drive-through facilities prohibition, enclosure and security requirements, application process, police department review, and on-site cultivation (§122-537).
Its use-specific standards for medical marijuana growing/manufacturing facilities address compliance with state law, separation from schools and other marijuana-related uses, on-site use or consumption, outdoor activities, inspections, recordkeeping, cessation of operations, drive-through facilities, enclosure and security requirements, storage of chemicals, application process, police department review, and on-site dispensing (§122-538).
The city’s medical marijuana code includes licensing requirements (§7-1 et seq.).
Social Service Uses
The city’s zoning code defines and regulates multiple residential and nonresidential social service uses. It defines “adult drop-in center,” “homeless shelter,” “substance abuse treatment facility, boarding,” “substance abuse treatment center, walk-in,” and “supportive housing” (§122.203).
It includes standards for adult drop-in centers (§122-510), homeless shelters (§122-532), substance abuse treatment facilities (§122-556), and supportive housing (§122-557) and it either permits or allows for a discretionary use permit of these facilities in certain districts (§122-461).
Food Systems | Urban Agriculture
The city’s zoning ordinance addresses urban agriculture. It allows urban agriculture and supporting facilities within certain districts (§122-461). Standards address setbacks, property maintenance, drainage, motorized equipment use, and composting; on-site sales are prohibited (§122-529). The code also defines community gardens (§122-203). It sets the parking requirements for urban agriculture related uses: none for community garden and 1 space for every 1,700 square feet of gross floor area, plus 1 space for each 300 square feet of office area (§122-691).
