Downtown Revitalization

The city’s codified ordinances establish two special administrative districts to manage downtown initiatives. It establishes the Mainstreet Downtown Development Authority as a special assessment district to guide downtown improvements (§§2-97–99). It establishes a Downtown Principal Shopping District to market downtown properties (§§2-99.1–99.4).

Residential Infill Development

The city’s zoning code includes development standards for residential infill to ensure context-sensitive infill in established residential areas (§39-9.09). These regulations apply to the placement, presentation, and character of new dwellings, accessory dwellings, and relocated buildings. The regulations define permissible infill lots, and cover procedures and required filings. Infill development standards include placement, height, scale, proportion, form, massing, directional emphasis, design details, and rear and side yard paving. 

Wind Energy

The city’s zoning code defines and regulates smaller on-site and larger utility grid wind energy systems. It differentiates the two by the primary intended use of the energy generated.

It permits on-site wind energy systems with rated capacities less than 30kW by right as accessory uses in all districts, subject to use-specific standards (§39-18.1). It regulates structure-mounted and freestanding on-site wind energy systems, providing separate setback standards for each (§39-18.1.c). It includes standards for noise, interference interconnection, and safety (§§39-18.1.d – g).

It allows utility grid systems and on-site systems that exceed by right permitting standards with a discretionary use permit, subject to use-specific standards (§39-17.h). These standards include setback, noise, safety, application and site plan, and utility infrastructure (§§39-17.h.1 – 7). It includes additional standards for utility grid wind systems including shadow flicker, visual impact, avian and wildlife impact, decommissioning, and interference (§39-17.h.8).
