This model ordinance provides a template to help cities in Pennsylvania develop wind energy regulations. It provides a framework for municipalities to either permit wind energy systems by right, subject to use-specific standards or with a discretionary use permit (§5). It includes setback standards from occupied buildings, property lines, and public roads (§9). All setback distances are a multiple greater than the tower height and vary by the categories above. It includes setback distance waiver provisions (§10).
It includes application procedures and standards for design and installation, public roads use, noise, shadow flicker, and decommissioning.
